This code applies to every subcontractor, supplier, consultant, and their employees and lower-tier vendors working on an ENG Contracting project or transacting with ENG. Acceptance of a subcontract or purchase order from ENG is acceptance of this code.
1. Compliance with law
Vendors comply with all applicable federal, state, and local laws and regulations, including procurement, labor, wage, immigration, environmental, safety, and anti-corruption laws, and with the terms of the prime contract flowed down in their subcontract or purchase order.
2. Safety
Vendors protect the safety and health of every person on site, including their own employees, ENG personnel, other contractors, and the facility's staff and occupants. Vendors maintain a written safety program, comply with ENG's site-specific safety plan, provide required training and equipment, and report every incident and near miss immediately.
3. Integrity
Vendors deal honestly with ENG, the owner, and one another. Vendors do not offer gifts, gratuities, favors, or anything of value to ENG employees or government personnel. Vendors submit accurate certifications, invoices, payrolls, and reports, and do not misrepresent ownership, certifications, or qualifications.
4. Labor and employment
Vendors pay their workers and lower-tier vendors accurately and on time, comply with prevailing wage requirements and certified payroll obligations, verify employment eligibility, and maintain a workplace free of discrimination, harassment, forced labor, and child labor.
5. Conduct on site
Vendors maintain a drug-free and alcohol-free workplace, treat facility staff and occupants with courtesy and respect, comply with the facility's security and access rules, protect the owner's property and information, and keep their work areas clean and safe.
6. Confidentiality and information security
Vendors protect ENG's and the owner's confidential information, including drawings, security information, and controlled unclassified information, and use it only for the project.
7. Conflicts of interest
Vendors disclose any relationship with ENG employees, owner personnel, or competing bidders that could create a conflict of interest, and refrain from any action that would create an organizational conflict for ENG on a government contract.
8. Reporting
Vendors report suspected violations of this code, the law, or the contract to ENG leadership at office@engcontracting.com. Reports may be made anonymously, and ENG does not retaliate against anyone who reports in good faith.
9. Consequences
Violations of this code may result in removal from the site, termination of the subcontract or purchase order, removal from ENG's prequalified vendor list, and referral to the owner or law enforcement where required.
